Focused Defense Representation For Under 21 Driving Crimes

Laws governing young drivers are almost always different from those governing people over the age of 21. In Illinois, the difference in treatment is noticeable in the consequences of various traffic violations. People over 21 are governed on a “three strikes and you’re out” policy, unlike of-age drivers.

Because of the severity of consequences facing underage drivers for driving crimes, it is important to contact a lawyer after receiving a traffic ticket. At Sullivan Law, PC in Fairview Heights, I have nearly 30 years of experience representing clients in Madison County, St. Clair County and throughout the St. Louis metropolitan area of Illinois in driving offenses.

Understanding The Rules

People under 21 are allowed one traffic violation in 24 months. If they get a ticket, they will get a notification stating that one more ticket will result in license suspension. It is important to understand that the 24-month period does not necessarily mean two calendar years. The time period starts at the end of their first conviction (whenever they pay the ticket, the trial is closed, etc.) and ends when the next ticket is issued.

Underage Drinking And Driving

In a similar manner, people under 21 who are pulled over on suspicion of drinking and driving will face more consequences than those over 21. Because Illinois has a zero-tolerance law, minors who consume any amount of alcohol before driving can have their license suspended, even if their blood alcohol content (BAC) is lower than .08.

All of the following crimes result in suspension of your license:

  • Consumption of alcohol
  • Possession of alcohol
  • Illegal transportation of alcohol
